Welcome to Discordium. By accessing or using our website, services, bots, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these terms.

To access certain features, you may need to create an account. You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to provide accurate and complete information and to update it as necessary.

You agree to use Discordium only for lawful purposes and in accordance with these terms. You agree not to:

• Upload or share harmful, abusive, or inappropriate content.

Our bots and services are provided "as is" without warranties of any kind. We reserve the right to modify, suspend, or discontinue any bot or service at any time without prior notice.

Certain Services may require payment. All payments are processed securely. Refunds are only provided in accordance with our Refund Policy.

All content, trademarks, logos, and intellectual property on Discordium are owned by us or our licensors. You may not use our intellectual property without our prior written consent.

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these terms or misuse the platform. You may stop using the Services and request deletion of your account and listings at any time.

Discordium services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all liability for:

• Service interruptions, delays, or downtimes.
• Loss of data or indirect damages.
• Damages caused by third-party links or content.
• Unauthorized access, misuse, or illegal conduct by users.

To the maximum extent permitted by applicable law, our liability is limited to cases of intent and gross negligence in accordance with the German Civil Code (BGB) and corresponding provisions of applicable US law (UCC). We are not liable for indirect, incidental, or consequential damages arising from your use of the Services.

You agree to indemnify and hold harmless Discordium, its operators, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these terms or the rights of others.

We reserve the right to modify these Terms at any time. Changes will be published on our website. Continued use of the platform following such updates constitutes acceptance of the new Terms. Material changes will be announced at least 14 days prior to taking effect.

These Terms shall be governed by and construed in accordance with:

• The German Civil Code (BGB) and the Introductory Act to the BGB (EGBGB) for users residing within the EU.
• Applicable federal and state laws in the United States, including the UCC, for users residing in the US.

The exclusive place of jurisdiction, where legally permissible, is Berlin, Germany.
